How it was worked out
- Monthly dues. 150 sqm × ₱10.00 per sqm = ₱1,500.00 a month. The rate is set by the association's board or general assembly under its by-laws. (Republic Act No. 9904, Magna Carta for Homeowners and Homeowners' Associations)
- Unpaid dues. ₱1,500.00 × 6 months = ₱9,000.00.
- Late penalty. Each unpaid month carries 2% of ₱1,500.00, ₱30.00, for every month it is late. The oldest month is 6 months late, so its penalty is ₱180.00. All months together: ₱630.00. (Republic Act No. 9904, Magna Carta for Homeowners and Homeowners' Associations)
- Total due. ₱9,000.00 dues + ₱630.00 penalties = ₱9,630.00.
- The rate per sqm, the penalty rate and whether it compounds come from your association's by-laws and board resolutions. Check them with the HOA office.
- Interest, legal fees and special assessments are left out. A dispute over dues can be brought to DHSUD, which regulates homeowners' associations.
- Each month is counted as late for every month until today, the oldest month the longest. Some by-laws start the penalty after a grace period; adjust the months if yours do.

Questions
Asked and answered.
How are HOA dues computed in the Philippines?
Most associations multiply the lot area in square meters by a monthly rate per sqm set by the board or general assembly. A 150 sqm lot at ₱10 per sqm pays ₱1,500 a month.
Can a homeowners' association charge a late penalty?
Yes, if its by-laws or a valid board resolution provide for one. RA 9904 lets an association collect dues and impose reasonable fines and penalties under its rules.
What is the difference between a simple and a compounding penalty?
A simple penalty is a fixed percentage of the unpaid dues for each month late. A compounding penalty also charges the percentage on penalties already added, so the amount grows faster.
Where do I complain about HOA dues?
Raise it with the association first. If it is not settled, the Department of Human Settlements and Urban Development (DHSUD) hears disputes involving homeowners' associations.
