How it was worked out

  1. Exclude the day of receipt. The notice was received on Sun, November 8, 2026, so day 1 is the next day, Mon, November 9, 2026. (Rules of Court, Rule 22 (Computation of Time), Rules 37, 41, 42, 43, 45 and 65)
  2. Count the period. Motion for reconsideration: 15 days under Rule 37, within the period to appeal. Sun, November 8, 2026 + 15 days = Mon, November 23, 2026. (Rules of Court, Rule 22 (Computation of Time), Rules 37, 41, 42, 43, 45 and 65)
  3. Move off a non-working day. Mon, November 23, 2026 is a working day, so it stays the last day. (Rules of Court, Rule 22 (Computation of Time), Rules 37, 41, 42, 43, 45 and 65)
  • Holidays counted: the regular holidays with dates fixed by law or by the calendar (New Year, Holy Thursday and Good Friday, Araw ng Kagitingan, Labor Day, Independence Day, National Heroes Day, Bonifacio Day, Christmas, Rizal Day).
  • Eid'l Fitr, Eid'l Adha, special non-working days and court closures are set by proclamation or order each year. Add them in the extra non-working days box.
  • Extensions are not automatic. A Rule 65 petition is generally not extendible, and an extension for an answer, a Rule 42 or a Rule 45 petition needs a timely motion and the court's grant.
  • This is a calculator, not legal advice. Check the date against the rule, the order and the court's own calendar.

Questions

Asked and answered.

How do you count the 15-day period to appeal in the Philippines?

Exclude the day you received the decision and count 15 days from the next day. If the 15th day is a Saturday, Sunday or legal holiday, the last day becomes the next working day (Rule 22, Section 1).

If the deadline falls on a Sunday, is it moved to Monday?

Yes. Under Rule 22, Section 1 of the Rules of Court, a last day on a Saturday, Sunday or legal holiday moves to the next working day.

From when is an extension of time counted?

From the original last day of the period, even if that day was a Saturday, Sunday or holiday, under A.M. No. 00-2-14-SC. It is not counted from the next working day.

How many days do I have to file an answer under the 2019 Amendments?

Thirty calendar days from service of summons, under Rule 11, Section 1 as amended in 2019. One extension of up to 30 days may be allowed on a motion for meritorious reasons.

How long is the period for a petition for certiorari under Rule 65?

Sixty days from notice of the judgment, order or resolution, or from notice of the denial of a timely motion for reconsideration.
